Justice for 18-Year-Old Olohiye Ehimiaghe, Killed at Ashley Gables Apartments

When multiple residents complain of lax security, referring to an Atlanta area apartment complex a “drug den,” could the owners and managers be liable for a fatal shooting on the property?

Police responded to a shooting at Ashley Gables apartments in Buckhead, Georgia on August 10, 2021. 18-year-old Olohiye Ehimiaghe was rushed to Grady Memorial Hospital where she died of her gunshot wound. According to news reports, police have charged Hilena Misganaw with manslaughter, but there is a question regarding whether the owners and managers of Ashley Gables apartments could have deterred the violence by providing reasonable security measures.

Online reviews of Ashley Gables apartments paint a picture of a pattern of neglect. One review complains specifically about a lack of security leading to “halls and elevators that reek of marijuana.” Another review complained about a security guard who was so lax, he failed to acknowledge delivery drivers.

When property owners ignore obvious criminal behavior and fail to take efforts to keep control of who has access to their property, they may be creating an environment that invites additional crime. Georgia law requires property owners and managers to take reasonable measures to protect residents and guests from foreseeable risks.
